Police state kids- home grown guilt!

Today in this alleged land of the free another story comes to me by someone that heard me on 580kido am boise on my morning rant from Sandpoint idaho. Evidently she heard me, looked up my website at www.tommunds.com, read my posts and thought i could do something for her.

This story , sad to say, is happening so frequently and is so typical that it seems many have become conditioned to such behavior and allow it without any regard to the encroachment on their rights and apparently the earlier they can scare our kids the more submissive people will be as adults.

A young kid with a few friends are pulled over one night for going 5 mph over the speed limit, when pulled over the cops suspect the driver was drinking under age, but did not test him, the officers trick them by saying they know what it was like when they were young like their buddies and get them to submit to a search where they find unopened beer in the truck, the driver, untested gets charged with a DUI and must obtain an SR22.

A few months later after he gets through his issues and has insurance he gets busted for not dimming his high beams fast enough as probable cause for another vehicle search when they find a small plastic wrapper with an immeasurable amount of a leafy substance and stated it was marijuana. The kid not knowing it was there or even if it was mj thought since he was driving that it would be appropriate to take responsibility as it would seem favorable to the officer. He was charged with possession and intent to distribute.

On probation with is sr22 payment being deducted from his debit account, loses his debit card one night and applies for another. Waiting for its replacement this kid forgets that his sr22 payment is debited from his account because his account is frozen.

Days before his new card arrives, his insurance payment attempted to go through his account and was denied due to insufficient funds. Due to the fact that this kid had a job and knew he needed to make his payment and was between a rick and a hardplace drives hoping that timing between the payment, his debit card and not getting pulled over, he drives to work hoping that it will work out and that if pulled over, the officers would be understanding

On the way home, after dark, he gets pulled over again for going 5 mph over the speed limit with no one on the road. He gets charged with probation violation, with DWP and the 5 mph was allegedly " probable cause"

In reading this post you may ask yourself whats the significance of this post? May i suggest if you have to ask you may be one of those that have also been conditioned to this form of tyranny.

You see, before this country was founded men under the tyrannical oppression of a king came to this new land to be free, sovereign and independent.

In the establishment of a new nation, the people created government specifically to protect their unalienable rights of life, liberty and property.

After years pass people with personal agendas, wealth and power have worked to undermine the limitations imposed on government and have taken the inherent power from the people and today using it against them, no longer to protect our rights but rather to dictate them, to incrementally remove each and every right until all rights we have are controlled by the one entity that was to preserve freedom of the people not to strip it away.

Our children today, live in a police state! They are conditioned at a young age to buy the fact that their rights never came from God, were not unalienable but were soley dependent on what government says they are and nothing could be more evident than in the way our law enforcement treats its people especially its kids.

Today our kids fear law enforcement because the parents of these kids were taught to fear government through unlawful submission.

I believe it was Jefferson that stated "when people fear their government. There is tyranny but when the government fears the people we have freedom."

This nation was founded on a free, sovereign and independent people, where government was to protect our rights and preserve them for future generations but instead has been trained to restrict these rights and freedoms in the name of security.

If for some reason you still don't understand my point, please don't hesitate to contact me.

For those of you that jump to conclusions, i am not against government, i am against tyranny in government, i am for limited government, with liberty and justice for all as was intended and to be held sacred by those that honored their oath!

Boise police continues to harass...

My son moved out just a few short months ago with a positive attitude. He is a young law abiding taxpaying man with his life full of promise. He has incredible looks, attitude, intellect, love for his family and friends and is loved by all hat know him.

Within weeks things seemed to change and real life set in. He had a job and is going to school to better himself with a rewarding career and now finds he no longer had the time to do as he wished and sees the world much differently.

My son not only finds that he no longer has the time he once had but thanks to law enforcement, no longer feels he has the freedom he once had, his attitude has changed dramatically because now he sees the things, related to current events, that I have been telling him about regarding the continual encroachments of government on our freedom and now believes me.

Beginning weeks after he moves out, he got a ticket for no front license plate, that he actually had on his dashboard, which we were told was actually ok, because he didn't have the holes in his bumper. As a matter of fact I told him not to worry about it because I didnt think it was that important because officers typically pull you over from behind anyway.

When my son was pulled over he didn’t  receive a fix it ticket or warning but penalties and fines and exceed their limits by asking him for his license and registration of which he failed to produce current insurance for which he told the officer was current. The officer not only not gave him a warning but also gave him a ticket for insurance to pay a fine.

Three days later he was traveling in Payette county and was pulled over because his license plate still was not put on because he hadn’t had time to put it on. My son again receives a fine for not only the license plate put failure to provide insurance again!

Weeks after securing the front license plate, he gets pulled over again, this time because the plate was crooked then again asked for license and registration and once again hit with a penalty because he didn’t have his insurance card because he hadn’t been home to get it!

Isn’t it a bit strange that he got hit twice in a week when two weeks later after he secured his plate the best he could without holes, he gets pulled over going eastbound by a west bound officer at 11pm because his front license plate allegedly was still not secure when in fact it was. He again was asked for his driver’s license and insurance card and was still ticketed with the license secured with a bolt and a cable tie?!
After this rash of detainments the past weeks were enough to pull the skin off my face until I got a call from my wife.

Evidently, My son and a few friends decided to go out to celebrate his 21st birthday. All was well while they were out to dinner, they finished and decided to stop at a gas station before heading home when as they pulled in they noticed an officer parked there.

After getting gas and a six pack of beer, the boys decided to pull out of the station and minutes later pulled up in front of their home when as they stopped were met with twirling lights from the officer from the gas station again!!!

The officer asked them if they knew why they were pulled over and the officer stated they failed to come to a complete stop before entering the roadway from the gas station and were speeding at 40mph in a 35mph?!

The officer asked the usual about drinking, license and registration when one of the boys handed them a concealed carry permit. At that time, six backup officers and a k-9were called.
When asked, the two kids stated they had a sip but the driver had not been drinking but the driver was tested for alcohol anyway?

The kids were then demanded to get out of the car and the car was searched with the k-9 dog while the kids were told to sit on their hands.

The officers as they were searching the car were laughing at the kids telling them that this was a birthday they would never forget.

The car was searched, the kids were harassed and after they were done the kids were let go.

When I called the watch commander he stated that he spoke to the officer and the officer said they were all drinking. The commander also stated he didn’t do a formal investigation but stated that normal protocol is to have the same amount of officers on the scene as those detained.

I told him my call was to find out what happened and to discuss it with my son and get back to them.

For those that have no clue, this is a major excessive use of unnecessary force and if left unchecked will result in yet more continued encroachments on people that were meant to be free and innocent until proven guilty and are not!

I will be pushing this on principle because due to the multitude of police violations, its time to address this issue and put a stop to this if possible which is doubtful.

My son had tremendous respect for those around him but suddenly in his effort to function normally and decently in society, he now feels like a criminal. I apologized as I told him, welcome to your future!

Met with Homedale police today

Met with Homedale police today. In my conversation with a young officer, he allowed me to share my concerns.

To begin my conversation i asked if he had ever been taught anything about constitutionists to which he interrupted, "sovereigns?" I said yes, and asked if he had ever heard of the SPLC, to which he stated he did.

He then stated he hears about sovereigns and the SLPC in their trainings twice or thrice a month! I asked him if he had learned about our history or the constitution to which he stated not really.

I asked him that if the SPLC was teaching that if constitutionist "sovereigns" are a threat, how would this be possible if government and the men in uniform took an oath to uphold the same law we subscribe to that makes us "sovereigns?"

I asked him if he realuzed that our founders in many occasions referred not only to "we the people" as "sovereigns" but the free and sovereign independent states as well and ask if knowing this would make any difference to which he stated it would make all the difference in the world!

I think i saw a lightbulb go on above his head and not the glassy eyed glare that i get from time to time when you lose someone in a conversation.

I then thanked him for his time and stated that i realized i was putting a target on my forehead but that i would challenge any police department, any county sheriff or state representative to prove me wrong. I also stated that i knew all or most sovereigns in this area and that not one of them i know has any malicious intent for government provided they acted in their proper authority protecting the rights if the people which was why their job was created.

. I stated, in closing that this country is going to hell ( he agreed) and there have been great attempts to pin government against its people. I asked if he would rather protect the people and have people protect and come to his aid if needed or would he prefer to protect the interest if government against its people to which he was silent and a bit perplexed.

I again thanked him for his time, told him that we appreciate them and to consider what i was telling him, gave him my card , stated if he had questions or someone up to the challenge i was ready.

I pray for this young nan as i do for all people that put themselves in harms way. I also pray that their ears are open to what i am saying to consider and challenge what they are taught and that my attempts and others to communicate and bridge the gap between law enforcement and the people are successful to avert an unnecessary catastrophe at the expense of those with money to fund an apparently destructive agenda, like the SPLC

May God help us realize that we are a lost, divided, immoral and ignorant nation and to help us restore our nation to greatness as we once were, one nation under God, indivisible with liberty and justice for all!

Why do they laugh?

This morning before my interaction with two law enforcement officers, i had heard them speaking about how fast and how much worse things are getting.

When they had mentioned the recent shooting of two canyon county officers i decided to chime in since it was just a few miles from my home.

I stated that i had only wished i had a scanner so that i could know what was happening and they had told me all analog scanner signals went digital and that they were too expensive.

I mentioned in addition to the cost i had heard that law enforcement had plans to intentionally scramble the signals so that the people would not have access to the digital signals anyway to which he had agreed, i was shocked that he confirmed what i had heard.

When i asked him why he stated that law enforcement did not want to have people or media aware of what they were doing because they would not only get in the way but complicate their job to which i suggested to them it was one more way to separate themselves from the people, to avoid accountability and to continue their encroachment on their limitations that were to safeguard the rights of the people to which i believe they have no concept.

When i mentioned the illegal forced entry in gem county by their sheriffs office they laughed and said " i hope they have their checkbook open"

I stated i was a constitutionist and they knew my truck already but immediately talking about how extreme we are carrying guns and stuff? Constitutionists, by its description are those that understand law, that uphold the law not break it!

After all, we are told ignorance of the law is no excuse, remember?

I asked theme who was more to be feared one that upholds the law or one that violates the law after taking a solemn oath to what makes them call us extreme?

I added that it was my interest and increased knowledge of law and the lack of constitutional knowledge in law enforcement that makes me want to add a constitutional law curriculum to the law enforcement academy because if we don't, we have no freedom but what they say we have!

I may be just a bit sensitive here but why would law enforcement laugh about an illegal forced entry unless they have no idea that the power was once inherent in the people?

Why would they think that it would be more beneficial to restrict our rights than to preserve them?

How do they think that by creating a division, The us v them mentality that we would still respect an officer that has no respect for the limitations of its duties or people it was to protect?

What if those we entrust to uphold the law don't know it?

What if law enforcers don’t know the law?
Who then is the criminal one that swore an oath and doesnt know  its intent  or the one that is forced to obey unauthorized laws that contradict the oath and law that he swore to uphold? If the law enforcers are considered above the law, should it not come with a higher level of accountability?

I was cruising down the street on Overland the other day thinking about how screwed up our country  is, as I usually do when I looked to my right and saw a law enforcement officer driving at inconsistent speeds as if he were distracted by something . Monitoring his driving for a few minutes I realized, at closer look, he appeared attentively looking at his mounted laptop!

The hair on the back of my neck stood on end immediately as I thought of the government’s continual control in the lives of normal unsuspecting inhabitants of Idaho as they implement various restrictions to control what we do in our cars like the texting ban. This bothered me so much I immediately called the local law enforcement entity to inquire how this can be.

I asked dispatch, “ Ma’am, as someone extremely interested in law and how it is applied and viewed by various governing entities, I do, from time to time, like to inquire about issues that come to mind and wondered if you could answer a few questions for me.”

As she accepted willingly, I continued… “The reason for my call is that I have been driving next to an officer for several minutes and noticed that he has been varying his speed as he appears distracted by his laptop. My question is that as I am aware of law enforcements support of measures to restrict distractions in the car by implementing texting bans and others, how is it that our law enforcement is not privy to the same laws that apply to the people?” She appeared stunned and apparently didn’t know what to say so she asked if it were ok to have someone return my call.

I figured that since she was nice I would also mention ”  in my experience with law enforcement over the last few years I am disappointed that they are no longer friendly as they once were. I understand their job is difficult but by creating such a cold personae, it further divides the law enforcement between the people creating an “us vs. Them” mentality  which becomes very uncomfortable and can be considered manipulative for those that not only have respect for our law enforcement but pay their salary and their retirement benefits as well.”

She, still friendly and apparently understanding, stated again that she would have someone call me back; I was thankful but was reluctant to think I would receive a call back from anyone, I thanked her for her time, asked her if I were respectful and when she stated I was, we ended the call.

To my surprise, today I get a call from not just dispatch or a patrol officer but one of the highest ranking officials in the department, I was surprised and elated! He even told me how lucky I was to receive a call from him!

When he introduced himself, he was cordial and sounded like someone that cared about my concerns which were welcome.

He began by stating that my question  had been considered to be answered by others but would be  most appropriately answered by him so I began…

“Sir, I am a tax paying law abiding person that has a passion for law and history and I like to try to understand what law is and how it is applied by various government entities and I had a question that I felt was legitimate and wondered if someone could help me understand it, he seemed engaged so I continued…

“ I was driving down the road the other day when I noticed that one of the officers appeared distracted by his laptop driving at varying speeds and excessive brake lighting in traffic and wondered how it is that the legislature can create a law, that law enforcement supports, that applies to some people but not all of them, specifically, how is it that laws can restrict the people but somehow exempt from law enforcement? (Are they now above the law? Aren’t all laws to apply to all people and isn’t the job of government entities to protect the rights of the people and not restrict them?)

He stated that originally the laws created applied to everyone but he had the restriction overturned as it applied to law enforcement because laptops are how they get their information. (so one high ranking law enforcement official can overturn a law that still applies to the people that they have been supposedly given the authority to  fine the people on a law that they are exempt from? Don’t the taxpayers also receive their information from their cell phones and can be just as important as an emergency? Furthermore, doesn’t government only have the power to do what we can only do to each other?

I asked him if he took an oath and if he remembered it and asked him “If you took an oath to uphold the constitution of the United states of America, the constitution and the laws of the state of Idaho what do you do when one, few or many of the laws violate or are contrary to either one constitution of both, which do you adhere to?” He stated:

“That’s what the Supreme Court is for!”  When this statement registered in my mind, fear settled in my bones knowing that we are in deep trouble in this country!  Not only was he a high ranking official that was entrusted to protect our rights, elected by the people but has violated his oath because that has no idea what his oath means or the original intent of the document that he swore an oath to. This should strike the fear in the people of Idaho and the nation in a big way and has huge repercussions to the people as our trusted officials continue to restrict the rights of the people and not even know it!

If we can no longer challenge authority, holding our government accountable, how will we know they have our best interest at heart? If those we have entrusted to know the law do not know the law or the difference between freedom and security and believe the Supreme Court has supreme authority to determine the rights of man, abandoning the three branches of government and the “checks and balances”  believing we are a democracy rather than a constitutional republic designed to limit government to protect the freedom of the people, would they then not see a difference between the supreme court and an English tyrant king? If they do not see the difference, were we as immigrants just wasting our time when we fled the tyrant king of Great Britain in search of freedom from such oppression? Shall we then prefer a king and is a king any different than a supreme court when its authority can never be challenged?

How sad it is when we in America, with all the sacrifices that have been made for freedom and liberty and justice for all, can be snubbed and blatantly disrespected by ignorant Americans and American governing entities promulgated by our Marxist public schools and still partake in the traditions for the sake of that freedom like the belief we are the land of the free, when we most assuredly are not!

It brings me to tears when I think about how off track we are.

How can we respect an entity that has no respect for those who have entrusted them to protect them?

How can “we the people” that have created government, and contained government through a written constitution begin to re-educate a government that obviously doesn’t know or care for people it funds?

How can we, respectfully, enter into dialogue to begin to change the hearts and minds of the government we created to tell them how far they have strayed from the original intent established by our Founding fathers and not be considered “Domestic terrorists” by law enforcement as defined by the Department of Homeland Security as they continually violate the rights of the people criminalizing them at the desire of our legislatures or by supreme court decree when they were never given such authority?

For anyone that reads this far, if you disagree, may I ask you to consider, simply for educational purposes, an open challenge, anywhere, anytime in public or private at the place of your choosing  to debate your worldview and mine as mine is based on years of study in American History, constitutional and common law  based on the foundation of Gods law vs the random and ever changing oppressive rules and laws of man that have never kept any society free but subjected, as history proves, to absolute despotism.  For those that are short sighted or unaware, our present system is set up to fail, to criminalize its citizens and no amount of legislation can fix it. The key is to return to the principles set forth by those who had more wisdom in that generation than all generations that have succeeded them.

If this appears like a plea, it is. God help us!

Funny thing happened on the way home from a basketball game

If any of you have read my previous posts or you know what Iv'e been up to lately, you will know from my bout with the school attorney stating I committed a crime by challenging the authority of the school board,  It struck enough fear in me with my knowledge of history and law to pursue my latest mission to to find out "What the rules are" What is the rule of law and what form of government  we have today in our town, our state and nationally and no one can seem to answer this simple question.

In my travels of speaking to Lieutenants and chiefs of the ISP and police departments, the county sheriffs and a wide variety of law enforcement officers my question is simply, if we are not a constitutional republic, what are we? If they take an oath, what do they take an oath to? If an oath is taken , isn't it important, why?

If they take an oath to the constitution, what if they do not adhere to it?

If we as "The people" established government to protect our rights and the power was inherent in the people and not our government, and the only document that protects us from government oppression is our rule of law that they swore to uphold, what happened?

Can they change the rules on us arbitrarily? If we are ignorant and apathetic rather than "eternally vigilent" that they can, without any authority I might add, but yes they can.

I had just finished forcefully paying 10.00 again to watch another of my sons games and on the way out I saw, not one officer, but three from the Sheriff's office. When asked why they were here, they replied that they were board...Really, so our hard earned tax dollars pay for sheriffs to be on duty to watch games when they are board?

I stopped one of them and gave him my card and told him I wanted to meet him because I was running for state legislature in this district. When he looked at the card,  he didn't really seem to interested and quite put off when I asked him if he could tell me what the rules are. When asked he told me that was up to the legislature, I said, hmm,. I think that would be up to the sheriff and law enforcement as enforcers of the law, wouldn't it?

If I ask him what the rules are and he tells me it is up to the legislature, shall I will assume he either didn't know or didnt want to answer me? Do you suppose if I did something illegal he would know and arrest me for it? I'm pretty sure he would. If he would then he must know the law because would think that what I had done would have been illegal. I mean they should know the law if they are the enforcers of it, shouldn't they and is the law they know a secret?

If our law enforcement was established to protect our rights as servants of the people, not to dictate those rights, then if were asked him something about law, shouldn't they be required to answer it?

If he failed to answer it and I had done something illegal without knowing it, and he arrested me would it have been fair, to pay his salary and retirement for life, while arresting me for a law I didnt know made something illegal?

At this point, they typically say "ignorance is no excuse of the law!" at which point I ask, if the power is inherent in the people  or the government and are you a servant of the people established  to protect the rights and supposed to know the law, would this phrase also apply to you as well?"

It should allow me to ask if they know their oath, where it originated and where the "ignorance" phrase also originated, or ask them, are you familiar with title 50 USC, for example and if they didn't know, shouldn't they? I mean governements originally really had no more power than what we could do to eachother, so could they or are they to have more power over the people than they do of themselves?

To get back on track, when I asked him if he knew who I was, he said clearly, he knew who I was and at that point had no interest in  any further communication.

How did he know who I was? How does every law enforcement officer at this school  in this town know who I am ? Why would they treat me this way, unwilling to chat, smile, and act as though they have a million other things to do when they came to the game because they were board? Was it something I said? Is it a crime to challenge authority?

Why do we pay for an entity to protect our rights when they watch over us like were criminals?
When I told him if we would give up our freedom for security, we deserve neither and both would be destroyed, he disagreed and I said you can't disagree with history, that quote came from one of our Founding fathers.

If one us disobeys the law,  it is considered crime, does that apply to everyone? Better yet, who is more of a criminal  one that didnt know they broke the law or one that did? Is there a difference if ignorance is no excuse? Can this apply only to the people, without also equally appying it to law enforment and every government agency?

The bottom line is this, we have a serious problem and it isn' necessarily the fault of our law enforcement, As a matter of fact I support them 100 % because of the detriment of nationalization  if we don't, that ushers in the usurpation of state powers in exchange for the police state under federal power, which will be the last nail in the freedom in any state or the union!

Our law enforcement put their lives on the line for us every day and we should be happy there are men that will do so and we need to honor them for it, I do. The problem is that they have all been successfully conditioned and educated something other that what was intended,  same with our military and it is our duty, that love them, respect them and honor them to re-educate them on what they are missing without beating them on the head when they will take the time to listen.

MYTH: Law enforcment is to protect the interest of the state
MYTH: It is constitutional to have long standing armies and be the worlds police
MYTH: Security is freedom

The bottom line is this, if you ask any officer they will tell you, they protect the interest of the state rather than the people. They are not taught the foundation of law, the origin of law, the jurisdiction of law, the value, purpose and significance of the Constitution and have no idea why the Bill of Rights was written or the purpose of it, if they knew, they would be horrified at how opposite their job is from its original intent.

This post. like all of them are written is a public clarification as to the events that occur in my quest to bring us back to the rule of law that we think is in place, to re-educate those whom are willing to listen  and to state publically, since I am getting so well known (good or bad, Im not so sure), that I have absolutley no intention to harm anyone, to break any laws, as long as I know what they are, or to disrespect the postion of authority. My question is simply and passionately and it will continue to be until I get the answer I believe the people have the right to know, to answer the following questions:

Who has the inherent power, the people or the government?

What form of government do we have?

What are the rules that we must play by in order to not break any laws?

Are these laws written or arbitrary or both?

Can you define and state what is needed in order for one to commit a "crime?"

Which law is supreme, school rule, the city ordinance, the state statute, the state constitution or the US Constitution?

What happens when one or several contradict eachother? Is there  a particular hierachical order?
and so on...

Can you answer them?

If you cannot, you may just be a criminal waiting to be caught for a crime you didn't teven know you commited...

If you are law enforcment and cannot answer these questions, "Is ignorance no excuse" and have you just broken the law as well as your oath to the people?

As I handed out my cards, I asked them to read my article coming out in the Middleton Gazette to better understand the method of my madness and not to pass false judgement on my character.

 I prayed silently that a seed be planted, that they would come to my site and consider what I am saying to be the truth and to know I mean no harm to anyone and that I too, am an enforcer of the law not one one whom cares to violate it.
