What is the Law? Is this a problem?

 Governments were created by "the people' to protect their rights, not to dictate them.

 Governments rule over their people and dictate the rights they never had authority to do. The following example sums up the award winning legal system in the freest county in the world

 Local tax paying Citizen in local school challenges his rights and that of his children in a district meeting,

 Gets letter from school attorney (Paid for by the tax payer to protect the school against citizen) stating he committed a crime.

 School board verbally states that they have not restricted citizen’s liberty (how Ironic is that?)

 When citizen writes response to attorney and never gets a written response, the citizen makes calls to attorney's office to see if he can get answers to his questions and gets repeatedly ignored and never a letter or a call back.

 When citizen writes letter to the Attorney General, he receives a letter that states the (taxpayer funded) AG's office was created to protect the interest of the state (Against the tax payer that pays their salary and retirement benefits for life) and is referred to an attorney because they can't give legal advice.

 Is asking what form of government we have today asking advice or holding our system accountable and their failure to answer the question negligent?

 What is the law? Is it what an attorney thinks it is, how about the supreme Court?

 In my quest to find out, I have contacted the Legislature, the Governor, the Attorney General, various senators, congressman and they all refuse to answer the question, WHY?

Isn’t the power inherent in the people that established government to protect the people and did we not reserve the right to hold them accountable to know what the laws are?

 Is there somewhere I can go to have someone tell me? What if no one knows the answer to the question? My guess, No one knows!

 How are “we the people” to know what the laws are and subject to them only when law enforcement states we have committed a crime? If we are not told what the law is, how can we be responsible for the knowledge of them and why then does this concept not apply to our created government?

 So, as I look at the constitution, which I was told a long time ago was our rule of law, I believe one must be a licensed BAR attorney in the state of Idaho to practice law. I realized that all the judges as well as the attorneys are members of the same organization that protects their interests of those in the organization (against the people)

 How does this protect my freedom if all government entities have created protective barriers from the people that entrusted their protection to said government?

 I received a tremendous wakeup call a few years ago and I concluded the following:

 God created man, which gave "the people' inherent authority

 God creates history where man can learn from previous mistakes

 Man created government to protect the God given rights of man

 Man creates three branches, checks and balances, constitution and Bill of Rights to insure that protection.

 Government creates agencies at tax payer expense to protect themselves from "the inherent authority" the people that fund their government

 Governments create BAR licensed requirement to protect the judges and attorneys from "the inherent authority"

 Governments no longer have to answer to the people, even with regards to what the rule of law is.

 Governments create schools to revise the understanding that power from people is from the government and that if there is no God, government must be God.

 Government re-writes history and usurps the power, it was never given to restrict man and instead of protecting our freedom, it instead restricts our freedom in the name of security that knows no bounds.

 When governments have control over the people, they rule over the people. When all the power is inherent in governments, as history dictates, eventually governments then kill the people that created government to protect their rights, known as tyrants.

 Our society is like all others before in history. Our present course is set up to fail due to our ignorance of law and the misplaced power of authority. The end result of a failed society is chaos, mass genocide and return to bondage.

 t is my duty as a father of four sons and a candidate for representative in the state legislature of my district of children and parents, to protect their future from tyrants.

 With all due respect, if law enforcement really cares about what they do, to protect the people and to maintain a civil society one must know the origin of the problem, the warning signs and written history because with all the well-intended attempts this society will fail.

 Does a man have the right to fight for his freedom and the liberty of his state and nation without suffering the consequences of someone that doesn’t even understand the rule of law?

 As I understand it, the rule of law needs not to be dictated by tyrants but is written in the hearts and minds of men and confirmed by the only documents to preserve our freedom, called the constitution and our Bill of Rights and that any law, statute or ordinance that is repugnant to it, is null and void.

 If you are ignorant of this fact and you are a government official that has sworn that oath to uphold and defend the constitution, who is guiltier, one that understands the law and the importance of the oath or someone that doesn’t?

 I feel it is only fair to warn you that you have been duped into believing that law is whatever man says it is which  is not the case in America.

 We are the rule of law in a constitutional republic, framed by the constitution and the Bill of Rights, limiting government while preserving freedom,  not subject to  the whimsical law of man.






A day at the Idaho crimminal justice meeting 1 27 2012

Friday morning, began with a guy that after reading a particular book, believes that things, in the criminal field are getting better, I wish I could see what he sees.

 Following up with this statement he shared his concerns about the Feds watching over the police departments, the rising crime in Seattle, Portland and Spokane and attributed the reasons to be due to politics, funding with no oversight, the militarization of police, improper training and of course, video. Police in several states are even wearing video cameras on their bodies to keep them accountable.

 What they were saying here peaked my interest and I couldn’t believe what I was hearing because I wondered if they saw these things that are so clear to me.

 Later in the meeting they were seeking funding for the treatment of juveniles and wanted more counties to participate.

 They communicated about new Dept. of Correction programs including gang assessment tools, 5 1/2 month rehab at tax payer expense and how beneficial it will be ( at whos expense?)

 Other topics were:

 Being out of compliance with SORNA.

 The need to re-categorize offenses into different tiers pending advise from psychologists using Dr. Bumby’s graph.

 Giving judges more options on how to become problem solving courts rather than just judge the law

 Officers completed misdemeanor probation academy

 Making offenders pay for their own testing.

 That according to 19-2608 they have the right to perform bodily fluid testing on individuals ( SJR102?)

 A power point presentation was next with Health and welfare talking about fraud and how to prevent it.

 He stated they have 580 staff, a 40% INCREASE over last year; they have 235,000 recipients and attribute growth to education? And is 100% FEDERALLY FUNDED.

 They say that anyone can use these welfare cards because there is no ID required but feel it is an invasion of privacy to ask?

 (Where does the authority come from for the state to accept federal money for living outside its budget?)

 A woman and the US marshal and US Attorney spoke about human trafficking, stated the buyer is the problem and that restitution should be considered.

 They stated under 18 USC 2423a, 2422B, and 1591, and 1595, they are justified in determining who the traffickers are, but said that their right to control is determining when illegal sex activities happens. (How can they know this when people are traveling unless they have seen people in the act? Is this another form of arbitrary control and up to the discretion of the FEDS? Seriously?)

 They stated how important it was for the FEDS to help with this problem in our state, under the UN protocol.



They also mentioned that since we have a constitution they use the “commerce clause” to gain the control necessary to combat this problem. ( this is ridiculous! I do not believe that the commerce clause was intended to have the federal government encroach on the states to find sex traffickers. If the constitution was written for a moral and religious people, can the constitution really still apply?)

 The stated the need to raise fines will help contain the issue.

 They initiated Project safe childhood which, no doubt they feel is a good thing but something tells me this is one more instance where the rights of good honest Americans will be violated again in the name of safety.

 With the aforementioned, There is no part of me that believes that this group has any intention on harming or restricting the rights of people, they in great part seem to be genuine people and passionate about their jobs and treated me very well.

 The problem is that every part our government is re-active instead of proactive!(not to be confused with preemptive.) and creates , in itself, the need to rule and control as an outcome of what it teaches!

  Today's attempts to create a better society are bandages and only address the symptoms of a much larger problem that people refuse to address, which is simple if people would just look.

 This system we have created is set up to fail. The origin of the problem is where the solution lays.

 Today, we praise our tolerance, diversity and equality. When we removed God from the school house, we taught our children to look to the government for all of their needs instead, that they are all entitled to believe how they want to and that everyone was on an equal footing.

 We teach our children, evolution, that they are an insignificant random chemical accident and therefore their life is of no value, they are taught that they cannot be held accountable or be responsible for the things they do because they are no better than animals which results in the need for more law enforcement to contain the multitudes of people doing what they feel is right as they were taught in taxpayer funded public schools.

 These issues are  self-perpetuating- increasing lawlessness, recidivism and retention rates as well as increasing the tax rates are other taxable efforts to bleed the wealth of the nation dry also resulting in the people’sreliance of government that when it fails people again in voicing their opinions are dependent on the need for law enforcement and the vicious circle continues, without a pro-active solution in sight.

 Once upon a time we taught to be proud, we shared what is referred to as “American exceptionalism” where we were united in our belief that our inalienable rights came from God and that governments instituted among men were to protect those rights not to dictate them.

 We believed that we were all fearfully and wonderfully made and put on this Earth for a specific purpose and that each one of us had a significant role to play, to live within the law, to take personal responsibility for our own actions, to be honest, to maintain integrity and to honor those establishments crucial to the prosperity of a nation, seem like America to you today?

 IN the governments self-created chaotic environment, it also creates the need to control the unrest it creates, the people must, without authority, subject themselves to the restriction of our rights that has always lead to tyrannical and despotic governments, where governments instead of protecting the rights of the people, now dictate them, then people begin to fight back.

 When governments have control over the people, they rule over the people. When all the power is inherent in governments, as history dictates, over time governments then kill the people that created government to protect their rights, and are known as tyrants.

If you are an American under the age of 30, you have probably figured out by now that the entire economic system is stacked against you.  The way that our economy is structured today is ridiculously unfair to younger Americans. 

 First, we endlessly push our young people to go to our ridiculously expensive colleges and universities where the pile up enormous amounts of debt.  Then they get out into the real world where they find that only a handful of really good jobs are available for the vast army of college graduates entering the workforce.  Sadly, most of the jobs that our young people are working these days do not pay enough to be able to support a family or buy a decent home.  Meanwhile, our politicians are busy mortgaging their future. 

 Our young people are expected to support a Social Security system that will not be there when they get older, and every single day more than 2 billion dollars is added to a debt that will hang around the necks of younger Americans and their children for the rest of their lives.  If you stop and think about all of this for too long, your head might just explode with anger.  Well, not literally, but you get the point.  The truth is that this is going to be the first generation in U.S. history that is going to do significantly worse than their parents, and that is a terrible shame.

Are you not convinced that things are really bad for younger Americans?
Do you think that they should just shut up and quit whining about things?
Well, keep reading.  You just might change your mind by the time this article is over.
The following are 24 facts that show how ridiculously unfair our economy is for Americans under the age of 30 that will make your head explode....

#1 U.S. households led by someone 65 years of age or older are 47 times wealthier than U.S. households led by someone 35 years of age or younger.
#2 Today, only about 55 percent of all Americans between the ages of 16 and 29 have a job.
#3 Back in the year 2000, more than 50 percent of all Americans teens had a job.  This past summer, only 29.6% of all American teens had a job.
#4 Since the year 2000, incomes for U.S. households led by someone between the ages of 25 and 34 have fallen by about 12 percent after you adjust for inflation.
#5 It is absolutely ridiculous how much it costs to get a college education in America today.  After adjusting for inflation, U.S. college students are now borrowing about twice as much money as they did a decade ago.
#6 Average yearly tuition at private colleges and universities in the United States is now up to $27,293.  That figure has increased by 29% in just the past five years.
#7 Back in 1952, a full year of tuition at Harvard was only $600. Today, it is $35,568.
#8 The cost of college textbooks has tripled over the past decade.
#9 In 2010, the average college graduate had accumulated approximately $25,000 in student loan debt by graduation day.
#10 At some point this year, total student loan debt in the United States will surpass the 1 trillion dollar mark for the first time ever.
#11 The total amount of student loan debt in the United States now exceeds the total amount of credit card debt in the United States.
#12 Our economy is not producing nearly enough jobs for our college graduates.  The percentage of mail carriers with a college degree is now 4 times higher than it was back in 1970.
#13 One-third of all college graduates end up taking jobs that don't even require college degrees.
#14 In the United States today, there are more than 100,000 janitors that have college degrees.
#15 In the United States today, 317,000 waiters and waitresses have college degrees.
#16 Right now, there are 5.9 million Americans between the ages of 25 and 34 that are living with their parents.  According to recent Census data, men are almost twice as likely to live with their parents as women are.
#17 At this point, there are more than 3.5 million Americans that are behind on their mortgage payments.  Young people that were offered "teaser rates" on their first homes before the housing collapse represent a large proportion of these mortgages.

I followed "the plan" to achieve the American dream and now I feel like I'm caught in a stagnant nightmare.
My husband now works for the Navy as a civilian and I am a high school teacher. We bought our two-bedroom townhouse nearly at the peak of the housing boom for $196,500. We're underwater on our mortgage with a high interest rate. I'm looking at having to stick with this house for eight, nine, 10 years.
I really would like to have two or three children, but I just don't think it's feasible to have that many children in this house. It's too small to have a family and it's not what I envisioned for myself when I followed the rules.
#18 The total value of household real estate in the U.S. has declined from $22.7 trillion in 2006 to $16.2 trillion today.  As noted above, large numbers of young Americans bought homes in the years leading up to the housing crash, and they lost a ton of wealth when home values plummeted.
#19 We are facing a retirement crisis that is absolutely unprecedented in U.S. history.  Right now, more than 10,000 Baby Boomers are turning 65 every single day.  Young Americans are expected to pay for their Social Security benefits, but Social Security will not be there when Americans under the age of 30 get older.
#20 Young Americans get arrested at a far higher rate than older Americans do.  Amazingly, 30% of all Americans get arrested by the time they reach the age of 23.  Once you spend time in prison, getting a good job becomes much tougher.
#21 Approximately one out of every five Americans under the age of 30 is currently living in poverty.
#22 In 2010, 42 percent of all single mothers in the United States were on food stamps.  A very large percentage of those single mothers are under the age of 30.
#23 According to one recent survey, only 14 percent of all Americans that are 28 or 29 years old are optimistic about their financial futures.
#24 The U.S. government is stealing about 150 million dollars from our children and our grandchildren every single hour.  Younger Americans will have to bear the burden of this debt far longer than older Americans will.
So what do you think about the plight of Americans that are under the age of 30?

Challenging school authority is a crime?

As several of you know and as I have posted before, at my attendence several moths ago in a local school board meeting I was sent a letter, by the tax payer funded attorney to protect their interests against the tax payer, that stated by challenging authority I committed a criime, I was outraged.

After a few weeks of thinking how to pursue this, I decided to respond back to the school attorney to have a few questions answered so that I was made aware of just what the laws were so I didn't violate them again as I am a law abiding citizedn, or so I thought.

When a month had passed and I still hadn't recieved a response, I  made several calls to his office, left messages and still no call. In the last call when I aksed why I wasn't getting my calls returned and asked if I needed to go there to wait for him, the secretary asked me if I was threatening her...Serioulsy? Since when is asking if I need to go to an office to wait to speak to soomeone a threat? Is that a crime as well, I was getting discouraged and angry.

A week later I wasn't quite sure what to so so I wrote a final notice and demand with a time of compliance that I felt was reasonable to get my questions answered or I would be forced to take further action.

Below is the letter from the attorney, re-written by me to post, followed by the my letter of response and also my final notice and demand. Also included is a link of an article I printed that I used to help make my point that I labeled addendum C.

If you are a parent paying taxes to your public school, this should concern you greatly because you now have no rights and your only right to redress your school district  is to spend money on a lawsuit!


Dear Mr. Munds,

 It has been brought to my attention that on September 12, 2011 at a regularly scheduled school board meeting for the ---- school district, you caused a disruption during the meeting. Specifically, it was reported to me that in a rather loud voice you called the superintendent and board members “a bunch of communists” or something to that effect.

This was stated in the presence of other patrons, employees and students.

 It is the position of the --- school district that it has no control over the content of your personal three minute talk. However, the school board does have need to control its meetings where there are no disturbances or incitetful rhetoric being provided to its employees and board members of the District. The manner of your demeanor is problematic. An orderly process has been established for patrons to make public statements during an optional hearing of [ signed in] visitors( up to a three minute duration) section. Beyond that, there are NO RIGHTS afforded for your display of your public behavior.

 In fact, Idaho Code sites it a crime for any parent, guardian or other person to upbraid, insult or abuse a teacher of the public schools in the presence and hearing of any pupil and that individual is guilty of a misdemeanor ( ID section 18-916). Of course, a teacher also includes certified administrators under the definitions set forth by the Idaho legislature. If such conduct is disruptive to the education process, a person may be excluded from attendance on any school property.

 If any further disruptive behavior from you is observed or experienced by the School board, the district will pursue your removal from attendance at these meetings.

Hopefully, we will not be placed in a situation where that will occur and you will abide by our rules, as far as utilizing the limited section “hearing of [signed in] visitors.

 PS The school board wanted me to inform you tht SECURITY CAMERAS, a closed campus and locked gates are all allowed under Idaho code section 33-512(11). (They may be allowed but are they in violation of our constitutional protection.? Only those that have read it and understand it would know.)


My response back to the schools attorney

Dear Mr. Attorney,
I appreciate your letter dated September 21, 2011 regarding the alleged disruption of the --- school board meeting. The intent of my reply is to ask you to clarify and provide answers for the questions I have listed below to help me become more educated on how law works and government entities function so that I may better understand my restrictions that are placed upon me without my knowledge.
I am a father of four boys that is gravely concerned with the legacy we will be leaving them after you and I are long gone. I have a deep passion  and reverence for our American heritage and spend every waking moment learning more about our Founding fathers as well as constitutional, Biblical and common law. Every day I realize that we are straying further and further from our founding principles and know enough about history to know the direction we are headed as a nation at warp speed. I am so passionate about this knowledge  I have decided to run for state legislature again in 2012.
I feel I am grounded, reasonable and logical  and my desire as a God fearing, law abiding, tax paying  American that loves our children and desires the preservation of freedom is to take every opportunity to reach out to others, to have them consider alternatives to the direction we are headed.
So, now that I have told you a bit about me, I would graciously ask that you could provide answers to these following  questions including statutes, policies,  codes, constitutional provisions and supreme court cases for each question so that I may better understand my restrictions and be aware of them so that I do not break any laws. I originally had 25 questions but in the interest of time, I limited it to 12.

1.       I am concerned about the schools continual unrestricted ability to encroach on the rights of the student, the parent and family supported by the government and confirmed by the legislature.

2.       Please define, in detail, what form of government we have today so that I may understand the rules?


3.        Is the Constitution still our rule of law, if so, is it living breathing or to be interpreted as the founders originally intended?

4.       Who decides when rights violations have been committed? If this power remains in government and not in the people, what do we have in place now to protect the people from the government, when they begin to tell us what our rights are? And how do we begin to implement this protection when needed?

5.       If law is no longer designed to protect the innocent and punish those who are guilty as it was intended and is to "to ensure social justice" how does this not subvert the original intent of the law and our republican form of government?

6.       If rights and truth are relative and ultimately up to interpretation, leaving the people powerless over their government and swearing of the oath is no longer important isn't it the job of the legal system to ensure the people's protection from such arbitrary laws?

7.       If we now rely so much on the Supreme Court for what our rights are, In your opinion is the Supreme courts purpose to dictate our rights rather than to preserve them and does this not make the supreme court nothing more than a tyrant king replacing our constitutional republic with  a monarchy defeating the purpose of a constitution as our written rule of law established to protect our rights not to dictate them?

8.       It is my understanding of law, that the constitution, and all laws made thereof shall be the Supreme law of the land and that all laws, ordinances, policies, rules and state constitutions repugnant to it are null and void ( Art. VI, Sec. 2a). If this is true, much of the Idaho state constitution is null and void especially Art. IX, Sec. 1, that states "the legislature shall establish a free common school" because it outside the "few and specific
 powers" delegated by Art. I, Sec 8?

9.       If Schools are "free" why are they paid for by the taxpayer? If they are free and paid by the taxpayer, why do we pay a tuition, why do we pay to eat lunch, pay to enter sporting events and pay again for at those concessions that the taxpayer already bought, than have to pay to use it after hours when we paid for it anyway? It seems inconsistent in the laws where we would call something free, when in reality it is more expensive than if it weren't free? If nowhere in the constitutions does it say that all salaries and benefits for life shall be guaranteed by the taxpayer are we free to assume it isn't necessary to pay tuition or to enter sporting events?

10.   You also state that Idaho code is a crime. Where and how is this possible when crimes require an injured party- the victim, the "corpus delecti" , the witness, and a trial by jury? Are you suggesting that the constitution has actually been suspended and that Title 50, USC, The War powers Act is in force where all lesser laws-all violations, policies procedures, rule and ordinances are now to be considered crimes? If so, should not the people be aware that the constitution is suspended, or is ignorance no excuse for the law? If this is so, does this   ignorance also apply to attorneys and government officials that have abandoned their oath and do not understand the Supreme law of the land? Which entity then that committed the crime should be considered more severe?

11.   How can people be held responsible for all laws that are created as the
 list of laws increases? Is this not restricting the liberty and freedom of people putting  them  in fear of doing anything in fear that they are committing a crime? Does this not
 violate the constitution’s guarantee of freedom and the concept that the
 power is inherent in and to remain in the people and not their government, and isn't it a
 form of tyranny? If not, please explain.

12.   Where does any government entity, like the school board, get the authority to tell us what our rights are, tell us what is and isn't constitutional and who decides when enough protection is enough or does it matter? If a board member or school teacher dislikes me or what I said at a board meeting, can they not consider me a threat and lock the school down when no threat was actually posed? Are their clear written times and events when this procedure takes effect or subject to arbitrary interpretation?

In closing, I appreciate the letter I received from you concerning the school district as well as your attention to addressing my questions as requested.  Again, to clarify my intent in this letter, it is only to obtain answers to the listed questions so that I may be better educated  and able to understand the limitations on my actions.

AFTER NO RESPONSE, MY FINAL NOTICE AND DEMAND LETTER






Mr. Attorney,

 By way of reintroduction my name is Tom Munds.  First I want to say, I respect all of your oaths of office and accept them, thank you for your service. 

I am writing this FINAL DEMAND LETTER & REQUEST FOR ANSWER because to date you have not provided me an answer to the questions I have concerning your letter representing the ----School District, September 21, 2011.  [See Addendum A my original letter], [See Addendum B Julian September Letter]

The issues that cause me great anxiety are those that harm my children and family and all others at the ----- School District who are afraid to speak out on these problems.  Specifically outlined in the first letter and to re-iterate, the loss of our personal freedoms e.g., paying for football games, parking issues, gated lots and lockdowns, inappropriate sexual innuendo by teachers and staff in front of and directing at children, forcing our children to sign documents under duress and coercion to play sports, stating vaccinations are regulations rather that suggested, then disallowing the Christian doctrine which this country was built on then turning around and busing children to see the Dali Lama (some did not bus children but other school districts did), teaching the philosophy of Humanism, and then not allowing us to bring our own food and drink to athletic events as well as having a school entity think they have the power to tell me what rights our community has.  All these trepidations listed are only a partial list of the whole and are not tied to public safety as the School District eagerly chants but a means of control; our School like others across the nation are indoctrination centers and a prison camps.  [See Addendum C]  I unambiguously demand you and the ---- School District to address these apprehensions immediately. 

The issues above carry tremendous significance for me, my family, and others that have experienced the same disparate treatment.  I want to understand how our ---- School District Superintendent is going to handle these problems and reparations, not just for our school district but how he will vote on the issue state wide and then ultimately what Mr. Luna’s position will be nationally.

 Since the time of my original letter, other issues have emanated that could be entered and discussed at this time however I will reserve the right to deliberate them later presuming you do not answer my original letter.  I believe a month has passed since I wrote my letter, by reasonable standard you have had adequate time to answer.  I have made numerous telephone calls to your office and as many messages have been left on your voice mail with no response,  all I am requesting is an answer, so I distinguish how to conduct my business with the ---- School District from this point forward.

As you can see I am directing copies of this correspondence to the appropriate State of Idaho officials in order that they can appreciate our circumstances concerning these issues, and hopefully they can aid your ability to give riposte to my enquiries.  To put in your terms how serious I am about these issues, I am committed to the following statement; should you not answer my letter within the next 15 business days, you will force me to take my legal remedies at law against your client in order to get these simple questions answered.  I trust you elucidate to the ----- School District that in my opinion your law firm stands to make a lot of money handling this concern, and the ---- School District may find it more cost effective to simply answer my letter then pay your exorbitant legal fees, especially since it has the outward appearance that you are prolonging an answer, one can only presume that you will bill more hours, in today’s down market billable hours are becoming tough to accumulate or in this case create.  Even defending a law suit is expensive when the Plaintiff might be judgment proof, and I would draw your attention to the whistle-blower statues that cover this issue.
